1. Acceptance of Terms

By downloading, installing, or using Simple Calorie Journal (“the App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of the App

Simple Calorie Journal is a locally stored calorie-tracking tool designed to help users estimate daily calorie intake and expenditure. The App does not require user accounts, does not display advertisements, and stores data locally on the user’s device.

3. Not Medical Advice

IMPORTANT:
The App is provided for informational and educational purposes only.

• The App does not provide medical, nutritional, or dietary advice.
• The App is not a substitute for professional medical advice, diagnosis, or treatment.
• Always seek the advice of a qualified healthcare professional before making changes to your diet, exercise routine, or health plan.
   

Use of the App is entirely at your own risk.

4. Calculations and Estimates

The App uses widely accepted scientific formulas to generate calorie estimates. However:

• All values are estimates, not guarantees.
• Individual metabolic responses vary.
• The developer makes no warranties regarding accuracy, effectiveness, or outcomes.
   

5. User Responsibility

You are solely responsible for:

• Verifying the accuracy of any data you enter
• Determining whether the App is suitable for your personal health situation
• How you interpret and act on the information provided

The developer is not responsible for decisions made based on App data.

6. Data Storage & Loss

All data is stored locally on your device unless you choose otherwise through system-level backups.

You acknowledge and agree that:

• Deleting the App may permanently delete your data
• Device failure, OS updates, or user error may result in data loss
• The developer is not liable for lost, corrupted, or inaccessible data

You are responsible for managing backups if desired.

7. No Warranty

The App is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, including but not limited to:

• Fitness for a particular purpose
• Accuracy or reliability
• Availability or uninterrupted operation
   

8. Limitation of Liability

To the maximum extent permitted by law:

The developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Health-related outcomes
• Weight loss or gain
• Physical injury
• Lost data
• Lost profits
• Device malfunction

Total liability, if any, shall not exceed the amount paid for the App (if applicable).

9. Indemnification

You agree to indemnify and hold harmless the developer from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your reliance on information provided by the App
   

10. App Updates & Changes

The developer reserves the right to:

• Modify or discontinue the App at any time
• Update these Terms without prior notice

Continued use of the App after changes constitutes acceptance of the updated Terms.

11. Termination

The developer may suspend or terminate access to the App at any time without notice if these Terms are violated.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the user’s state of residence, without regard to conflict-of-law principles.
